Understanding the EB1A Requirements
The EB-1A employment-based immigration visa is designed for aliens of "extraordinary ability" in the sciences, arts, education, business, or athletics. It is one of the most desirable US Green Cards because it does not require an employer sponsor (self-petition) and typically has no backlog for most countries.
The "Extraordinary" Standard
To qualify, you must demonstrate regular international or national acclaim. You must prove that you represent the small percentage of individuals who have risen to the very top of your field. There are two ways to meet this standard:
- One-Time Achievement: A major, internationally recognized award (e.g., Nobel Prize, Pulitzer, Oscar, Olympic Medal).
- The 3-of-10 Method: Failing a one-time major award, you must provide evidence for at least 3 of the 10 USCIS criteria listed in our calculator above.
Does Meeting 3 Criteria Guarantee Approval?
No. This is a common misconception. Meeting 3 criteria is just the first step (the "regulatory" phase). USCIS officers then perform a "Final Merits Determination," looking at the totality of the evidence. They ask: Does the evidence demonstrate that the applicant is at the top of their field?
This is why our calculator asks about "Evidence Strength." Mere membership in a generic association might technically fit a category but fail the Final Merits test. The key is sustained acclaim and significance.
